Heard learned counsel for the Parties.

The Petitioner has the specific pleading through Paragraph-4 onwards of the Writ Petition that in undertaking of a Mega Drinking Water Project, the Petitioner has difficulty to have access to his own Plot No.3289. The Petitioner claimed that he has the only access to his own Plot No.3289 from Plot Nos.3280 and 3281. The Petitioner has the specific plea that there was no other access to touch his Plot and he has the only access through the Plot involved herein. Even the Petitioner through the diagram attempted to establish his such allegation. This Court here finds, on the selfsame issue, the Petitioner has already made a complaint to the Tahasildar, Nimapada, O.P.5 through Annexure-3 series.

Considering the request of the Petitioner for consideration of his representation, this Court in disposal of the Writ Petition directs O.P.5 to look into the grievance of the Petitioner and find out if the Petitioner has any alternative access to his own Plot. In the event of no alternative access to the Petitioner's Plot indicated herein above, O.P.5 shall find out the access to the Petitioner's Plot by undertaking an enquiry and involving the Petitioner as well as any other persons likely to be affected by such decision. The entire exercise will be completed within a period of one and half months from the date of communication of this order. If no construction work has commenced, there may not be commencement of any construction in the meantime.
