I.A. No.1472 of 2022 1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This I.A. has been filed by the Petitioner seeking modification of the condition and extension of time to surrender. 3.

Heard learned counsels for the parties.

It is submitted by learned counsel for the petitioner that on the selfsame occurrence, two F.I.Rs. have been registered, i.e. Samal P.S. Case No.4 of 2022 and Samal P.S. Case No.5 of 2022. 5.

Considering such submission, order dated 29.07.2022 passed in ABLAPL No.2490 of 2022 stands modified to the extent that the Criminal Antecedents of the Petitioner shall be verified and if it is found that the Petitioner has more than one Criminal Antecedent of similar nature, as indicated hereinabove, then this bail order shall not be given effect to.

Four weeks' further time from today is extended for the Petitioner to surrender before the learned court below, vide the aforesaid order dated 29.07.2022, but subject to depositing cost of Rs.500/- (rupees five hundred) by the Petitioner in the Advocates' Welfare Fund of Orissa High Court Bar Association within 15 days from today and furnishing money receipt thereof in proof of the deposit.

It is made clear that, if the cost is not deposited within the time stipulated, the time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.
