Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 25.01.2022 in connection with Mohana P.S. Case No.52 of 2015 corresponding to G.R. Case No.26(A) of 2015, pending in the Court of learned Special Judge, Gajapati, Paralakhemundi for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

As it appears nothing was seized from the possession of the petitioner and that he was implicated in the case on the basis of the statement of the co-accused.

Having regard to the above, the period of detention in custody and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition

that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
