The Petitioner in this writ petition seeks for a direction to the Principal Secretary to Government in Revenue and Disaster Management Department, Bhubaneswar-Opposite Party No.1 to dispose of the representation dated 21st February, 2022 under Annexure-4 series within a stipulated time.

The grievance of the Petitioner in this writ petition is with regard to the action of the Tahasildar, Ghasipura in rejecting the application for demarcation of land in respect of Plot No. 190/761 under Khata No.46/617 of mouza Ghasipura in the district of Keonjhar vide his order dated 28th January, 2021. 4.

Taking into consideration the submission made by learned counsel for the Petitioner, this Court vide order dated 13th April, 2022 directed learned State Counsel to take instruction in the matter. Mr. Mishra, learned Additional Standing Counsel, on instruction, submits that the Petitioner

// 2 // wants to take advantage of date of the order reflected in the order sheet, i.e., 28th January, 2021. However, the same is an inadvertent one and if permitted, the Tahasildar, Ghasipura will recall the said order and pass a fresh order in L.I. Case No. 295 of 2020 in accordance with law.

In view of the above, this Court disposes of this writ petition granting liberty to the Tahasildar, Ghasipura to recall the order dated 28th January, 2021 and pass a fresh order in L.I. Case No. 195 of 2020 in accordance with law giving opportunity of hearing to the parties concerned.

Urgent certified copy of this order be granted on proper application.
