CORAM:
JUSTICE BISWANATH RATH
ORDER
5.7.2022 Order No.
05.
1.
Heard learned counsel for the Parties.
2.
The Writ Petition involves an allegation against the statutory authority in not receiving the Appeal Memorandum submitted by the Petitioners appears to be under Section 22 of the OSS Act, 1958 3.
Considering the allegation to be serious, this Court observes, it may be altogether a different aspect as to whether such Appeal is entertainable or not and in such event, it may depend on the ultimate order likely to be passed by the appellate authority but in no circumstance, there is refusal to receive the Appeal Memorandum if submitted.
4.
In the process, this Court disposing of the Writ Petition permits the Petitioners to offer the Appeal Memorandum to the Sub-
// 2 // Collector-cum-Settlement Officer, Puri, O.P.3 within seven days along with copy of this order. In such event, the appellate authority shall do well in receiving the same, registering it and passing lawful order. This Court has not expressed any opinion on the entertainability of the Appeal even.
