This matter is taken up through Hybrid Mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in T.R. Case No. 332 of 2020 arising out of Tentulikhunti P.S. Case No. 141 of 2020 on the file of learned Additional Sessions Judge-cum-Special Judge, Nabarangpur for the alleged commission of offence under Sections 376(2)(n)/376(3)/313/294/506/34 of the I.P.C. and Sec. 6 of the POCSO Act. Petitioner is stated to be in custody since 17.10.2020.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judgecum-Special Judge, Nabarangpur by order dated 22.01.2021, in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that notice has been duly served on Opposite Party No.2. The same has also been noted by this Court by order dated 2.05.2022. There is no appearance on behalf of the informant.

Perused the 164 Cr.P.C. statement of the victim. 7.

Taking into account the period in custody, this Court directs that the Petitioner shall be released on bail. The learned court in seisin over the matter shall fix the term. 8.

Accordingly, the BLAPL stands disposed of.

9.

Urgent certified copy of this order be granted as per rules.
