1. This is an application under Sec.439 Cr.P.C. for bail and the offence alleged is under Sec.302, I.P.C.
2. Heard Mr. J. Sahoo, learned counsel for the Petitioner as well as Mr. P.K. Mohanty, learned A.S.C. for the State-Opposite Party.
3. It is submitted that the Petitioner is inside custody since 5.11.2018 and while rejecting his prayer for bail earlier by order dated 29.06.2020 in BLAPL No.7725 of 2019, liberty was granted to him to renew his prayer for bail after examination of the key eye-witnesses, Narayan Rout. In the meantime, said Narayan Rout has been examined as P.W.1 by the learned trial court, who has turned hostile by not supporting the prosecution case.
4. After hearing learned A.S.C. for the State-Opposite Party and upon perusal of the copy of the deposition of the said P.W.1
(Narayan Rout) under Annexure-2 and the period of detention of the Petitioner inside custody as well as other circumstances of the case, it is directed to release the Petitioner on bail in connection with Kabisuryanagar P.S. Case No.230/2018 corresponding to S.T. Case No.119/2020 (S.T. Case No.76/2019) on such terms and conditions to be fixed by the learned Addl. Sessions Judge, Kodala as he deems just and proper including the condition that the Petitioner shall not be involved in any other offence while on bail and shall attend the trial court on each date fixed.
5. The BLAPL is accordingly disposed of.
6. An urgent certified copy of this order be granted on proper application.
