This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 23.01.2022 in connection with Boudh P.S.
Case No.152 of corresponding to C.T. Case No.306 of 2015(A) pending in the Court of learned S.D.J.M., Boudh for the alleged commission of offence under Sections 147/148/341/354/302/506/149 of IPC.

It is alleged that the petitioners along with some other persons committed the murder of one Jogindra Naik by assaulting him with sharp cutting weapons. In the meantime, all the material witnesses including the informant and eyewitnesses have been examined in the original trial held in respect of co-accused persons. None of them have supported the case of the prosecution. The petitioners are facing trial in
the split up case.

Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
