Heard Mr. S.K. Mohanty, learned counsel for the Petitioner and Mr. K.K. Das, learned Additional Standing Counsel for Opposite Party - State.

It is submitted on behalf of Petitioner that he was earlier released on bail by the learned J.M.F.C., Kabisuryanagar on 26th September, 2018 in G.R. Case No.216/2017(A). The alleged offences are under Sections 399/402 of I.P.C. read with section 25(I-B)(a) of Arms Act. After commitment, the case was registered as Sessions Trial No.131 of 2019 in the court of learned Addl. Sessions Judge, Chhatrapur, Ganjam. Subsequently, due to non-taking of steps by his conducting counsel, NBW of arrest was issued against him vide order dated 9th December, 2021.

Thus considering the limited nature of prayer and after hearing learned counsel for the State, the CRLMC is disposed of with the direction that in the event the Petitioner surrenders on or before 12th
April, 2022 before the learned court below and moves for bail, he be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter including the condition that he shall attend the court on each date fixed. 4.
The CRLMC is disposed of.
