This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Standing Counsel.

This Petitioner has filed the present writ application with the following prayer:

"It is therefore, prayed that for the interest of justice and equity your Lordship may kindly be graciously pleased to issue Rule Nisi calling upon the Opposite Parties to show cause as to why the Petitioner is not entitled to get the benefit as like as Banka Bihari Panda and why he will not get the pensionary benefit although throughout his service career he had served as a work charge employee without any stigma.

If they fail to show cause or show insufficient cause, the Rule may kindly be made absolute.

Necessary direction/writ may kindly be passed

It is submitted by the learned counsel for the Petitioner that the Petitioner has submitted a representation ventilating his grievance before the Engineer-in-Chief, Water Resources Department, Opposite Party No.2 on 27.06.2021 under Annexure-6, which has not been considered as of now and seeks for a direction to consider the representation and dispose of the same within a stipulated period of time.

Learned Additional Government Advocate has no objection if a direction is issued to the Opposite Party No.2 to consider and dispose of the representation of the Petitioner within a stipulated period of time strictly in accordance with law. 6.

In such view of the matter, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.2 strictly in accordance with law within a period of six weeks from the date of production of certified copy of this order. Further, the Opposite Party No.2 is directed to dispose of the same strictly in accordance with law by passing a reasoned and speaking order after affording opportunity to the Petitioner. The decision so taken on the representation of the Petitioner shall be communicated to the Petitioner within two weeks thereafter.

With the aforesaid observation, the writ application stands disposed of.

Issue urgent certified copy as per Rules.
