1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. A.N. Samantaray, learned counsel for the Petitioner and Mr. S. Mansingh, learned counsel appearing for the Opp. Party.
3. This transfer petition has been filed by the Petitioner-wife seeking transfer of C.P. No. 54 of 2022 from the Court of learned Judge, Family Court, Cuttack to the Court of learned Judge, Family Court, Kendrapara.
4. It is contended that the Petitioner is residing at Kendrapara along with the minor children and she is not in a position to attend the Court at Cuttack. Though Mr. Mansingh, learned counsel has already entered appearance for the Opp. Party after receipt of the notice, but no objection has been filed to the transfer petition. However, it contended by Mr. Mansingh that the Petitioner was earlier residing at Cuttack and accordingly, she can participate in the proceeding before the learned Judge, Family Court at Cuttack.
5. Having heard learned counsel for the Parties and taking into account the fact that the Petitioner has got two minor children with
// 2 // her and the other grounds taken in the transfer petition, this Court is inclined to allow the prayer for transfer of C.P. No. 54 of 2022 from the Court of learned Judge, Family Court, Cuttack to the Court of learned Judge, Family Court, Kendrapara. Accordingly, this Court directs learned Judge, Family Court, Cuttack to transfer C.P. No. 54 of 2022 to the Court of learned Judge, Family Court, Kendrapara forthwith.
6. The transfer petition is disposed of.
