Heard learned counsel for the Petitioner.

This Writ Petition involves rejection of an application under order 7 Rule 11 of Code of Civil Procedure involving the election dispute. Though there is raising of serious dispute on limitation aspect, for the consistent opinion of this Court, there is no application of provision under order 7 Rule 11 of Code of Civil Procedure to Election dispute.

Be that as it may, while declining to interfere with the impugned order passed in Election Petition No. 3 of 2022, this Court observes, in the event the Petitioner brings such dispute through its objection to the Election Petition, there may be appropriate issue and exercise on such issue may be undertaken in the ultimate trial of the election dispute.
