This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.697 of 2019, on the files of learned Additional Sessions Judge-cum-Special Judge, Jeypore, Dist-Koraput, in T.R. Case No.68 of 2019, arising out of Nandpur P.S. Case No.50 of 2019, under Sections 376(2)(n)/417/506 of IPC and read with Section 6 of the POCSO Act and is in custody since 29.08.2019.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Court of the Additional District & Sessions Judge, Jeypore, by order dated 09.12.2019 in the aforementioned case, the present BLAPL has been filed. 5.

It is noted that notice has been duly served on the informant through the Court and date of appearance was fixed to 10.01.2022.

None appears for the Victim when the matter is called. 7.

Taking note of the evidence of the victim as P.W.1 recorded on 29.11.2021 which is taken on record, this Court directs the petitioner to be released on bail, on such terms to be fixed by the learned Court in seisin over the matter, so as to ensure his presence on each date of trial 8.

The present BLAPL is disposed of accordingly. 9.
