This matter is taken up by virtual/physical mode. 2.

The Petitioner is a defaulting borrower, availed house building loan of Rs.3,50,000/- with EMI at Rs.3,814/- in 180 equated monthly installments. Due to financial indiscipline, the account was declared as NPA on 10th July, 2020, consequent upon which the Opposite Party No.2, namely, Chief Manager, Recovery Department, Bank of Baroda, Sambalpur Region invited the Petitioner for availing opportunity of one time settlement. Since, the one time settlement did not progress, in anticipation of coercive measures by the Bank Authorities under the SARFAESI Act, 2002, the writ petition has been filed.

On 4th April, 2022, learned Counsel for the Petitioner prayed for some time to place on record instructions.

When the matter is taken up today, Mr. Debendra Kumar Sahoo, counsel for the Petitioner filed a Memo under his signature to the effect that as per the instruction, the Petitioner does not want to prosecute the writ petition any further and accordingly sought permission to withdraw the same.

In view of the above, the writ petition is dismissed as withdrawn.
