This matter is taken up through hybrid arrangement (virtual/physical mode).

This is the second journey of the petitioner, who is in custody in connection with Kumbharapada P.S. Case No.127(17) of 2019 arising out of G.R. Case No.1156 of 2019 pending in the Court of the learned S.D.J.M., Puri for offence punishable under sections 498(A)/306/304(B)/201/406/34, I.P.C. read with section 4 of the D.P. Act in filing the petition under section 438 of Cr.P.C. for his release on bail in the event of his arrest.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made and on going through the materials on record as also the earlier order rejecting the prayer for grant of anticipatory bail to the Petitioner, who is the husband of the deceased, finding no such changing circumstances, I am not inclined to reconsider the
// 2 // prayer for grant of anticipatory bail to the Petitioner. It is, however, observed that in the event the Petitioner surrenders within a week hence in connection with the aforesaid case and moves for his release on bail, the observation made in the earlier order dated 03.09.2021 shall hold the field. 5.
The ABLAPL is accordingly disposed of.
