This matter is taken up through Hybrid mode.

This is an application filed by one Bhikari Charan Senapati and 27 others for modification of order dated 17th February, 2022 by which the writ petition, i.e., W.P.(C) No. 7407 of 2020 was disposed of.

Mr. Mohanty, learned counsel for the applicants in the Interlocutory Application submits that during pendency of the writ petition, they had filed an application for intervention in IA No.12716 of 2020, but without considering their application, the writ petition was disposed of vide order dated 17th February, 2022 with the following direction.

Accordingly, the writ petition is disposed of with a direction to Opposite Party no.5-Collector-cumAdditional Registrar of Cooperative Societies, Jagatsinghpur to take a decision on the enquiry report submitted by ARCS-Opposite Party No.4 and take suitable action as expeditiously as possible, preferably within a period of four months from the date of production of
// 2 // certified copy of this order giving opportunity of hearing to the parties concerned."
It is his submission that the present applicants apprehend that they may not be given an opportunity of hearing before the Collector, Jagatsinghpur as they were not made parties to the writ petition. Hence, the aforesaid Interlocutory Application has been filed.

Mr. Das, learned counsel for the writ petitioners submits that that apprehension of the applicants is baseless as they have not yet approached the Collector, Jagatsinghpur for redressal of their grievances.

Since this Court, while disposing of the writ petition, had directed the Opposite Party No.5-Collector-cum-Additional Registrar of Cooperative Societies, Jagatsinghpur to take a decision on the enquiry report submitted by ARCS-Opposite Party No.4 providing opportunity of hearing to the parties concerned, the order dated 17th February, 2022 requires no modification. The applicants in the Interlocutory Application, if so advised, may appear before Opposite Party No.5-Collectorcum-Additional Registrar of Cooperative Societies, Jagatsinghpur and in such event, he shall afford them opportunity of hearing in the matter of taking a decision on the enquiry report of ARCS-Opposite Party No.4.

With the aforesaid observation, the IA is disposed of. Issue urgent certified copy of the order on proper application.
