The present petitioner is alleged to have assaulted the deceased with a thenga, while he was engaged in argument with one Kailash Naik.

Trial in this case is stated to have been commenced and some of the witnesses have already been examined.

Regard being had to the facts and submissions, nature of allegation, stage of the proceeding and factum of permanent residence

of the petitioner, it is directed that, the petitioner shall be released on bail by the learned Addl. Sessions Judge, Bhanjanagar, Ganjam in S.T. No.59 of 2007 on such terms and conditions as deemed just and proper in the facts and circumstances of the case. 6.

The BLAPL is accordingly disposed of.
