Misc. Case. No.560 of 2016 & W.A. No. 331 of 2016 05.

1. There is an inordinate delay of 192 days in filing the present writ appeal. The explanation offered by learned counsel appearing for the Appellant in the application for condonation of delay is neither satisfactory nor convincing. Consequently, the Court is not inclined to condone the delay.

2. Nevertheless, the Court has also examined the matter on merits. On the previous date, i.e., 10th October, 2022 learned Additional Government Advocate appearing for the Appellant had sought more time to inform the Court on whether any policy has been formulated for allotment of Government Quarters to the Journalists.

3. Mr. Debakanta Mohanty, learned Additional Government Advocate appearing for the Appellant places before the Court a

communication dated 8th December, 2022 of the General Administration and Public Grievance Department, Government of Odisha informing him that "no policy has been formulated yet for allotment by (sic) of Government quarters to the Journalists at Bhubaneswar"

4. In that view of the matter, since no policy has yet been formulated, the impugned order of the learned Single Judge is confined to the facts of the case. In other words, it will not constitute a precedent.

5. Accordingly the writ appeal and pending applications are disposed of in the above terms.
