Heard learned counsel for the Petitioner.

For the consistent view of this Court, this Court is not inclined to interfere with the order involving the Application under Order 39 Rule 3 of C.P.C. However, considering there is urgency involving the request in I.A. No.1/2022, this Court permits the Petitioner in the event there is no appearance of the opposite parties therein to take out Special Messenger notice on the O.Ps. therein for expediting their appearance. This Court further directs, in the event the Petitioner undertakes Special Messenger notice exercise in making of appearance of the O.Ps. and deposits the money accordingly, the trial court shall in issuing notice of appearance to contesting parties fixing short returnable dates and do well in completing the exercise involving I.A. No.1/2022 at least within a period of two weeks from the date of appearance.

The CMP stands disposed of accordingly.
