This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners as well as learned counsel for the State.

The sole grievance of the petitioners is that although minimum Performance Based Incentive has been sanctioned to the petitioners, the authorities have not paid that part of the performance incentive during particular period has already been released in favour of the petitioners. However, authorities have not sanctioned and cleared the Performance Based Incentive for the period from 27.09.2015 to 31.03.2018 to the petitioners.

It is submitted by learned counsel for the Petitioners that although the petitioners are entitled to, due to inaction of the authorities performance based incentive, has not been paid as of now. Learned counsel for the petitioners further submits that they have already filed detailed representation before the authorities

// 2 // highlighting their grievances, which is pending before the authorities for consideration.

Learned counsel for the State submits that he has no objection, if a direction is given to the authorities to consider the representation of the Petitioners within a stipulated period of time. 6.

Considering the submissions made by learned counsel for the parties, limited nature of grievance of the petitioners and the fact of the present case, this Court disposes of the writ petition with a direction to the Mission Director, National Health Mission, OdishaOpposite Party No.1 to consider the representation of the Petitioners dated 13.04.2018 under Annexure-6 series in accordance with law within a period of two months from the date of production of certified copy of this order. It is further made clear that the Opposite Party No.1 shall consider the representation of the petitioners and dispose of the same in accordance with law and shall be considered by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the Petitioners within a period of two weeks thereafter.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
