This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as the learned counsel appearing for the State.

The Petitioner has filed this Writ Petition with a prayer to quash the departmental proceeding and to allow the Petitioner to avail duty pay salary during medical leave period and posted in a School where vacant post of Head Sevak is available. 4.

It is submitted by the learned counsel for the Petitioner that the Petitioner has filed representation before the Collector, Dhenkanal, Opposite Party No.1 on 30.12.2021 and 10.01.2022 under Annexure5 series, but the said Opposite Party No.1 has not considered the representations of the Petitioner as of now.

Learned counsel appearing for the State submits that he has no objection if a direction is given to the Opposite Party No.1 to consider the representation of the Petitioner within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, this Court disposes of the writ petition with a direction to the Collector, Dhenkanal, Opposite Party No.1 to consider the representation of the Petitioner dated 30.12.2021 and 10.01.2022 under Annexure-5 series within a period of two months from the date of production of certified copy of this order. It is needless to mention here that the representation of the Petitioner shall be considered by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the Petitioner within a period of two weeks thereafter. 7.

With the aforesaid direction the writ petition stands disposed of.
