This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to the Tahasildar, Sorada to take a lawful decision on the representation of the Petitioner dated 21st September, 2021 under Annexure-2 series as per the direction of Revenue Divisional Commissioner, (Southern Division), Berhampur vide order dated 16th February, 2022 under Annexure-3.

Mr. Mahanty, learned counsel for the Petitioner submits that the Petitioner is in possession over Plot No. 739/3466 to an extent of Ac. 0.490 decimals and Plot No. 749/2916 to an extent of Ac. 0.336 decimals under Khata No.2021 situated in mouza Sorada under Sorada Tahasil in the district of Ganjam (for short 'the case land'). 4.

In Objection Case No. 56/84/1139, the Settlement Officer had also allowed the claim of the Petitioner in part. In spite of the same, the case land has not been recorded in the name of the Petitioner. Hence, the Petitioner submitted a representation before the Tahasildar, Sorada on 21st September, 2021 under Annexure-2 series,

// 2 // but to no effect. Thereafter, the Petitioner moved the Revenue Divisional Commissioner, (Southern Division), Berhampur, who by his Letter No. 415 dated 16th February, 2022 under Annexure-3 requested the Tahasildar, Sorada to take necessary action in the matter and submit a report. But, no action has yet been taken on the same. Hence, this writ petition has been filed for the aforesaid relief. 5.

In course of hearing, Mr. Mahanty, learned counsel for the Petitioner submits that interest of justice will be best served, if the Petitioner makes an application in proper format before the competent authority for settlement of the case land in his favour and prays for withdrawal of the writ petition.

Considering such submission, this writ petition is disposed as withdrawn.

Urgent certified copy of this order be granted on proper application.
