The Petitioner has come up before this Court challenging the demand notice bearing No. 351 dated 2nd March, 2022 issued by Superintendent of Excise, Gajapati. The demand is essentially raised for the period from 23rd August, 2021 to 31st January, 2022 for nondeposit of un-utilization fees for want of utilization of Mohua Flower fixed for R.Udayagiri OS Main Shop, R.Udayagiri in the district of Gajapati as required under the Excise Policy for the year 2021-2022. 3.

When the matter is taken up today, the counsel for the Petitioner seeks withdrawal of the writ petition with liberty to file fresh writ petition with better particulars.
