This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Special T.R. Case No. 116 of 2020 corresponding to Balimela Excise Station P.R. No. 50 of 2020-21, pending on the file of the learned Sessions Judge-Cum-Special Judge, Malkangiri, for the alleged commission of offence under Sections20(b)(ii)(C) of the N.D.P.S. Act. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-cumSpecial Judge, Malkangiri by Order dtd. 30.09.2020 in T.R. No. 116 of 2020, the present BLAPL has been filed. 4.

Heard Mr. R.L. Pattnaik, learned counsel for the petitioner and Mr. K.K. Gaya, learned counsel for the State.

Taking into account the manner of seizure, this Court is not inclined to consider the bail application of the petitioner at this stage.

Accordingly, the BLAPL stands rejected and giving liberty to the petitioner to renew his prayer at later stage. ( V.Narasingh ) Balaram Judge
