This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel for the State.

The present writ petition has been filed by the petitioner with the following prayer :- (i) Under the circumstances, it is humbly prayed that this Hon'ble court may graciously be pleased to issue a writ in the nature of mandamus or any other appropriate writ/writs by directing the Opposite Party No.2 to open the P.F. account in favour of the petitioner and grant EPF Family pension w.e.f. the date 14.12.2019, the sate when the husband of the petitioner died with current and arrear.

(ii) And pass such other order/orders as would be deemed fit and proper.

It is submitted learned counsel for the petitioner that the petitioner has submitted detailed representation highlighting his

// 2 // grievances before the Commissioner, Employees Provident Fund, Bhubaneswar dated 05.07.2020 and thereafter dated 05.01.2021. It is further submitted by learned counsel for the petitioner that the authorities have not taken any action on the representation filed by the petitioner as of now. He further submits that in the event a direction may be given to the Opposite Party No.2 to consider the grievance of the petitioner in accordance with law within a stipulated period of time then the same would suffice.

Considering the submissions made by learned counsel for the parties, limited nature of grievance of the petitioner and the factual background of the case, this Court disposes of the writ petition with a direction to the Commissioner, Employees Provident Fund, Bhubaneswar-Opposite Party No.2 to consider the representation of the Petitioner, which are pending before him in accordance with law within a period of two months from the date of production of certified copy of this order. It is further made clear that the Opposite Party No.2 shall consider the representation of the petitioner and disposed of the same in accordance with law by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the Petitioners within a period of two weeks thereafter.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
