1. This matter is taken up through hybrid arrangement.
2. Heard.
3. In this writ petition, the petitioner challenges the order of recovery dated 19.02.2022 under Annexure-8 passed by the opposite party No.1- Director of Technical Education and Training, Odisha, Cuttack without giving any opportunity to him.
4. At this juncture, learned counsel for the petitioner has shown the receipts of payment made to the opposite party No.2Principal, Bhubanananda Orissa School of Engineering, (BOSE), Cuttack.
5. In view of such proof shown by the petitioner, it reveals that the petitioner has paid the entire dues and according to the petitioner, nothing is pending against him.
6. In that view of the matter, the order of recovery dated 19.02.2022 under Annexure-8 passed by the opposite party No.1- Director of Technical Education and Training, Odisha, Cuttack is set aside. The matter is remitted back to the opposite party No.1- Director of Technical Education and Training,
// 2 // Odisha, Cuttack to pass fresh order considering the proof of payment to be submitted by the petitioner and giving opportunity of hearing to him. The petitioner shall submit the copies of the receipts regarding payment of dues before the opposite party No.1- Director of Technical Education and Training, Odisha, Cuttack.
7. Accordingly, this writ petition is disposed of.
8. Urgent certified copy of this order be granted on proper application.
