Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioners are in custody since 19.01.2022 in connection with Khetrajpur P.S. Case No.20 of 2022 corresponding to T.R. Case No.1 of 2022 pending in the Court of learned Sessions Judge-cum-Special Judge, Sambalpur for the alleged commission of offence under Section 20(b)(ii)(C)/29 of NDPS Act.

It is alleged that the present petitioners and two other persons were in possession of contraband ganja weighing 28 Kg 665 grams which they were transporting from Odisha to the State of Bihar.

It is submitted that the statutory formality relating to search and seizure has not been followed. Moreover, the mode of weighment of the contraband article is also doubtful. 6.

Considering the submissions, materials on record and taking into account the period of detention in custody without commencement of trial, I am inclined to allow the prayer for

bail. Let the petitioners be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that they shall furnish cash security of Rs.20,000/- each and shall personally appear before the trial Court on each date of the posting of the case without fail. Further they shall not leave the territorial jurisdiction of the Court below without obtaining leave and in case leave is granted, they shall furnish their contact address and mobile numbers to the Court as well as the I.O. 7.

BLAPL is accordingly disposed of.
