This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The sole grievance of the Petitioner in the present writ petition is that he has submitted a representation before the Secretary to Government, Food Supplies and Consumer Welfare Department, Odisha, Bhubaneswar, Opposite Party No.1, dated 20.12.2021 (Annexure-5). It is submitted by learned counsel for the Petitioner that no action has been taken by the Authority concerned on the representation filed by the Petitioner. Moreover, it is submitted by learned counsel for the Petitioner that the Authority has stopped the salary of the present Petitioner, while sitting over the representation of the Petitioner and not deciding the same.

Learned counsel for the State on the other hand submits that since the Petitioner has submitted a representation which is pending before the Government in Food, Supplies & Consumer Welfare Department, Odisha, let the Opposite Party No.1 decide the said
// 2 // representation of the Petitioner within a stipulated period of time within a stipulated period of time.

Considering the aforesaid submission of the respective parties, this Court disposes of the writ petition at the stage of admission directing the Opposite Party No.1 to consider the representation of the Petitioner dated 20.12.2021 (Annexure-5) within a period of one month from the date of production of certified copy of this order. Further Opposite Party No.1 shall consider the representation of the Petitioner strictly in accordance with law and dispose of the same by passing a speaking and rezoned order. Decision so taken be communicated to the Petitioner within a period of two weeks from the date of such decision. Authorities are further directed not to take any coercive action against the Petitioner till disposal of the representation by the Opposite Party No.1. 6.
It is submitted by learned counsel for the Petitioner that Petitioner is not getting salary although he was working at the present place of posting. In the event if it is found that the Petitioner is working in the new place of posting, the Authority shall look into the matter and release the salary of the Petitioner expeditiously. 7.
With the aforesaid observation the writ petition stands disposed of.
