Heard Mr. Achyutananda Pattnaik, learned counsel for the petitioner and Mr. S.S. Pradhan, learned Addl. Government Advocate for the State.

This is an application under Section 439 of Cr.P.C. for grant of bail to the petitioner-Anil Kumar Sundaray in connection with Jankia P.S. Case No.78 of 2021 corresponding to G.R. Case No.432 of 2021 pending in the Court of learned S.D.J.M., Khurda where the petitioner alongwith the other accused is facing trial for commission of offences under Section 395 of the I.P.C. read with Section 25 of the Arms Act in the Court of the learned C.J.M. -cum- A.S.J., Khurda. 4.

This is the second journey of the petitioner to this Court seeking bail. His earlier application BLAPL No.5328 of 2021 had been dismissed as withdrawn on 15.02.2022. 5.

This matter has been listed alongwith BLAPL No.2094 of 2022 filed by co-accused Govind Jena. Perused the report dated 24.08.2022 received in BLAPL No. 2094 of 2022. The learned Chief Judicial Magistrate, Khurda has reported that out

of 21 charge sheet witnesses, 4 witnesses have been examined including the informant as P.W.2 and the case stands posted to 01.09.2022 for further trial.

Mr. Pattnaik, learned counsel for the petitioner wants to withdraw the bail application with liberty to move the learned trial Court for bail after examination of the witnesses on 01.09.2022.

Considering the said prayer, the BLAPL is disposed of as withdrawn.
