Heard learned counsel for the Petitioner.

The CMP arises out of rejection of an Application under Order 7 Rule 11 of C.P.C. Undisputedly, in the event the said Application was allowed, the main proceeding would have been taken away. In the process, this Court finds, no CMP is entertainable.

Learned counsel for the Petitioner wants to withdraw the CMP with liberty to file Revision.
