This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for modification of the orders dated 05.04.2022 and 24.11.2022.

After going through the averments taken in the interim application and on hearing the learned counsel for the State, it is observed that in the event the bail application filed by the petitioner after surrender in the Court of learned J.M.F.C., Brahmagiri in G.R. Case No.116 of 2022 is rejected in the first hour and an affidavit is filed before the concerned Court that the petitioner will move the application for bail on the same day before the Court of Session, without

// 2 // awaiting for formal orders from the Court of Session, the learned Magistrate shall transmit the case record to the Court of learned Sessions Judge, Puri and the learned Sessions Judge or the Court to which bail matter is assigned shall dispose of the bail application at an earliest preferably on the same day, if time permits and date of surrender as per the orders dated 05.04.2022 and 24.11.2022 is extended till 17.12.2022. It is made clear that no further extension shall be granted to the petitioner.

The rest part of the orders dated 05.04.2022 and 24.11.2022 shall remain unaltered.

Accordingly, the I.A. is disposed of.

Urgent certified copy of this order be granted on proper application.
