Heard Mr. Pratap Kumar Sahu on behalf of Mr. D.K. Mohanty (1), learned counsel for the Appellants and Mr. R.K. Biswal, learned counsel for the claimant - Respondent.

Present appeal is by the employer challenging award dated 17th January, 2019 of the learned Commissioner for Employee's Compensation-cum-Divisional Labour Commissioner, Cuttack in E.C. Case No.127-D of 2016 wherein compensation to the tune of Rs.10,53,571/- has been awarded on account of death of the deceased in course of his employment.

It is submitted that in terms of order dated 12th July, 2019 of this Court, 30% of the total compensation amount has already been released in favour of the claimant in the meantime.

In course of hearing both parties agree for settlement of the dispute upon payment of further sum of Rs.6,20,000/- consolidated. Accordingly the compensation is reduced to the aforesaid amount besides 30% already paid.

Since the entire amount has been deposited before the learned Commissioner, out of the same a consolidated amount of Rs.6,20,000/- along with accrued interest thereof be disbursed in favour of the claimant within a period of two months from today and the rest amount with proportionate interest accrued thereon be refunded to the Appellant.

With the aforesaid observations the appeal is disposed of. 7.
