This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Government Advocate.

The present writ application has been filed for a direction to the Opposite party to dispose of the representation of the Petitioner which is filed along with this writ application at Annexue-4. It is further submitted by the learned counsel for the Petitioner that the Opposite Party may be directed to consider the representation of the Petitioner within a stipulated period and the same be disposed of by a speaking and reasoned order takinginto consideration the documents filed by the Petitioner in support of his claim as well as the judgment relied upon by the learned counsel for the Paetitioner.

The Petitioner in the present writ application has challenged the non-sanction of pension and other pensionary benefits as provided
// 2 // under OCS(Pension) Rule, 1992 in his favour.

It is submitted by the learned counsel for the Petitioner that highlighting his grievance, the Petitioner has filed a representation before the Executive Engineer, Minor Irrigation division, Ganjam-II, Berhampur dated 18.08.2021 under Annexure-9 and the said representation is pending as of now.

Considering the limited nature of grievance, this Court disposes of the writ application directing the Executive Engineer, Minor Irrigation Division, Ganjam-II, Brhampur, Opposite Party no.5 to consider of the representation of the petitioner dated 18.08.2021 within a period of two months from the date of production of certified copy of this order. The Opposite Party No.5 shall consider the representation of the Petitioner strictly in accordance with law and dispose of the same by passing a reasoned and speaking order. The decision so taken on the representation of the Petitioner be communicated to the Petitioner within two weeks thereafter.

With the aforesaid observation, the writ application stands disposed of.
