IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.6723 of 2022 Biswajit Samal ....
Petitioners Mr. G. Behera, Advocate -versusState of Odisha & Ors.
....
Opposite Parties Mr. R.P. Mahapatra, Addl. Govt. Adv.
CORAM:
JUSTICE BISWANATH RATH
ORDER
31.03.2022 Order No.
01.
1.
Learned counsel for Petitioner argues that once the High Court in disposal of a writ petition directs the Collector to consider the claim of the Petitioner, the Collector is required to consider all aspect involved herein. Taking this Court to the impugned order, an allegation is made that there has been no appropriate consideration of the issue and the consideration is made even without providing ample opportunity to the Petitioner.
2.
Considering nature of dispute this Court is of the view that order of this Court directing the Collector to consider the grievance of the Petitioner does not mean; the Collector will also consider the right of the parties in the opening of lock, for which alternate mechanism is there.
// 2 // In the circumstance, this Court declines to interfere in the impugned order. However, this Court observes, if the Petitioner is so advised, may avail the remedy of civil dispute for this purpose. 3.
With the aforesaid observation the writ petition stands disposed of.
