W.P.(C) No.6786 of 2022 Sk.Nazir ....

Petitioner Mr.J.R.Dash, Advocate -versusState of Odisha and others ....

Opposite Paries Mr. Y.S.P.Babu, A.G.A.

CORAM:

JUSTICE A.K. MOHAPATRA Order No.

ORDER

07.04.2022 01.

1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2.

Heard learned counsel for the Petitioner.

3.

After going through the order dated 07.07.2021 passed in W.P.(C) No.17625 of 2021 under Annexure-5, this Court finds that there is a clear direction to the Opposite Parties to regularize the service of the Petitioner and grant all consequential benefits as due and admissible to him in accordance with law within a period of three months. However, the Opposite Party No.1 the Principal Secretary, Housing and Urban Development Department, Government of Odisha by order dated 30.09.2021 has rejected the prayer of the Petitioner for regularization of his service. This Court is of the considered view that the order dated 30.09.2021 passed by the Opposite Party No.1 is in clear violation of the order dated 07.07.2021 passed by this Court in W.P.(C) No.17625 of 2021. 4.

In such view of the matter, this Court feels that no further direction is necessary. The Petitioner has to approach this Court by filing an application under the Contempt of Court's Act for violation

// 2 // of the Court's order.

5.

Accordingly, the writ application is disposed of granting liberty to the Petitioner to file a contempt application. 6.

Issue urgent certified copy as per Rules.
