Heard Mr. B. Jalli, learned counsel for the Petitioner and Mr. H.M.Dhal, learned Addl. Government Advocate for the State. 3.

The present Writ Petition has been filed with the following prayer:- " It is, therefore prayed that let this Hon'ble Court may graciously be pleased to issue a writ of mandamus by directing the opp. parties more particularly to the opp. party no.2 to pay/release the assessed compensation amount of plants/fruit bearing trees of Rs.1,09,440/- under Annexure-2 along with 30% solatium and 12% interest per annum to the petitioner immediately".

Since the Petitioner claims for release of the compensation amount, it is open to him to pursue his remedy in accordance with the provision contained in National Highways Act, which is applicable to him.

With the aforesaid observation, the Writ Petition stands disposed of. 6.

Issue urgent certified copy as per Rules.
