As there is issuing of notice in CMA No.47 of 2021, there cannot Order No.

be any direction for early disposal of the same in absence of sufficiency of notice involving the proceeding in trial court. In the circumstance, the Civil Miscellaneous Petition is not entertainable at this stage. Petitioner while permitting to withdraw this Civil Miscellaneous Petition also permitted to move this Court for early disposal after the notice is made sufficient involving the proceeding involved herein.

The Civil Miscellaneous Petition stands disposed of with the observation made hereinabove.
