Santosh Kumar Singh v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 2311 of 2022 Santosh Kumar Singh ....
Petitioner Mr. S. Dwibedi, Advocate - Versus - State of Odisha ....
Opposite Party Mr. A. Pradhan, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
12.04.2022 1.
This matter is taken up through hybrid mode.
Order No.
2.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
The petitioner is in custody since 19.09.2020 in connection with P.R. No.6/2020-21 corresponding to 2(a)CC Case No.7 of 2020 pending in the Court of learned Special Judge, Phulbani for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act.
4.
Having regard to the fact that the seized contraband is more than commercial quantity, being 150 kg of ganja, I am not inclined to allow the prayer for bail, which is therefore rejected. However, considering the fact that the petitioner is in custody since 19.09.2020, learned trial Court shall do well to expeditiously dispose of the case, preferably within a period of four months. 5.
BLAPL is accordingly rejected.
(Sashikanta Mishra) Judge A.K. Rana
