This matter is taken up through hybrid mode.

This writ petition has been filed for a direction to the Superintendent of Police, Vigilance, Bhubaneswar-Opposite Party No. 2 to give clearance to Nayagarh District Central Cooperative Bank Ltd., Nayagarh-Opposite Party No. 1 as requested vide letter dated 7th July 2020 under Annexure 9.

Pursuant to direction of this Court, Mr. Das, learned Standing Counsel for the Vigilance Department, on instruction, submits that said letter dated 7th July, 2020 (Annexure-9) of the Opposite Party No. 1Bank has not reached the office of Superintendent of Police, Vigilance, Bhubaneswar-Opposite Party No. 2. As such, the prayer for grant of clearance as requested under Annexure 9 does not arise at all. 4.

Mr. Satapathy, learned counsel for the Petitioner referring to the additional affidavit filed by the Petitioner submits that said letter under Annexure-9 was issued to the office of Opposite Party No. 2 on 8th July 2020 under Aannexure-11 by courier service.

In view of the submissions made by learned counsel for the parties, this Court finds that the issue involved in this writ petition is with regard to issuance of clearance as requested vide letter dated 7th July, 2020 under Aannexure-9. Thus, there is no difficulty at present for the Opposite Party No. 2 to take cognizance of the said letter annexed to the writ petition as Annexure-9 and take a decision thereon. 6.

In view of the above, this Court disposes of this writ petition with a direction that on supply of a copy of the letter dated 7th July, 2020 under Annexure-9 issued by the Opposite Party No. 1-Bank by Mr. Das, learned Standing Counsel for the Vigilance Department within 3 (three) days hence, the Superintendent of Police, Vigilance, Bhubaneswar-Opposite Party No.2 shall take a decision thereon as expeditiously as possible preferably within a period of six weeks therefrom and communicate the same to the Opposite Party No.1-Bank forthwith.

Urgent certified copy of this order be granted on proper application.
