This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard Mr. K.P.Mishra, learned Senior counsel for the Petitioner and Mr. Y.S.P. Babu, learned Additional Government Advocate for State.

This is the second journey of the Petitioner to the Court. Earlier the Petitioner has filed W.P.(C) No.37389 of 2021 wherein this Court has directed to consider and dispose of the representation of the Petitioner which is filed along with the present writ Petition as Annexure-3 i.e. representation dated 28.08.2020. 4.

It is submitted by the learned counsel for the Petitioner that the order dated 08.12.2021 passed in W.P.(C) No.37389 of 2021 has not been given effect to and accordingly the representation of the Petitioner has not been considered.

This Court is of the opinion that if the order dated 08.12.2021 passed in W.P.(C) No.37389 of 2021 has not been complied with, it is open for the Petitioner to initiate a proceeding under the Contempt of Court's Act against the opposite Parties for non-compliance of the

// 2 // order passed by this Court. Therefore, the Court shall examine the issue and take necessary action against the opposite parties. 6.

However, it is open for the Opposite Parties to comply with the order dated 08.12.2021 passed in W.P.(C) No.37389 of 2021 in the meantime and the representation pending before the Collector, Cuttack be disposed of as expeditiously as possible for compliance of the order dated 08.12.2021 passed in W.P.(C) No.37389 of 2021. 7.

The writ application stands disposed of.
