This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to restrain the Opposite Parties from evicting him from Government Quarter No.Type 2RB/4, BJB Nagar, Bhubaneswar. 3.

Mr. Pradhan, learned counsel submits that the Petitioner has retired from Government service and is occupying the aforesaid Government quarters allotted in his favour during his continuance in service. He retired from service as Joint Secretary, Home Department, Government of Odisha, Bhubaneswar. He wants to retain the aforesaid quarters to facilitate higher studies of the children. However, the Rent Officer, G.A. & P.G. (Rent) Department, Government of Odisha, Bhubaneswar vide letter dated 3rd February, 2022 under Annexure-1 has issued notice to the Petitioner to vacate the said quarters. Hence, this writ petition has been filed for the aforesaid relief.

Taking into consideration the facts and circumstances of the case, this Court is of the considered opinion that the prayer made in this writ petition is misconceived one and cannot be entertained. Accordingly, this writ petition is dismissed. Urgent certified copy of this order be granted on proper application.
