// 2 // Heard Mr. S.C. Puspalaka, learned counsel for the petitioners and Mr. A.K. Beura, learned counsel for the State as well as Mr. Partha Sarathi Nayak, learned counsel appearing for the informant.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Ghatagaon P.S. Case No.43 of 2022 corresponding to G.R. Case No.411 of 2022 pending in the Court of learned S.D.J.M., Keonjhar for the commission of the alleged offences punishable under sections 279, 323, 379 and 34 of the Indian Penal Code.

In terms of the order dated 19.04.2022, learned counsel for the State has produced the written instruction dated 03.05.2022 received from the Inspector-in-charge of Ghatagaon police station which indicates that the petitioners appeared before him but did not cooperate in the investigation and did not furnish their valid mobile numbers as well as any identification ID. The written instruction obtained by the learned counsel for the State is taken on record. In view of the instruction received from the Inspector-in-charge of Ghatagaon police station and since the petitioners have failed to comply the order dated 19.04.2022, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender in the Court

// 3 // below within a period of four weeks from today and move for bail, the same shall be disposed of as expeditiously as possible by the Court below in accordance with law. The case records shall be made available to the Court concerned.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
