Heard learned counsel for the petitioners and learned Addl. Standing Counsel for the State.

The petitioner no.1 is in custody since 25.02.2021 and petitioner no.2 is in custody since 19.02.2021 in connection with Orkel P.S. Case No.203 of 2020 corresponding to G.R. Case No.876 of 2020 pending in the Court of learned S.D.J.M., Malkangiri for the alleged commission of offence under Sections 302/201/34 of IPC.

It is alleged that the petitioners held a grudge against the deceased on the ground that he was practicing witchcraft causing all sorts problems for the villagers. They accosted him in liquor shop of Angra Sisa and abused him. Thereafter they asked the said Angra Sisa to leave the spot, whereupon they are said to have killed the deceased by shooting arrows from the bow as also by assaulting his head by means of a stone. There are no eyewitnesses to the occurrence. The case rests entirely on the circumstantial evidence in the form of the extra-judicial confession said to have been made by the accused persons before the wife of the deceased. That apart the bows and arrows have
been recovered at the instance of the accused persons. Apart from the above there is no other material to show their complicity in the alleged occurrence.

Taking into consideration all the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
