Undisputedly the petitioners appear to have been duped by Order No.

persons involving F.I.R. at the instance of the petitioners in achieving an agreement in between the petitioners involved herein and in the guise of Cuttack Municipal Corporation entered into such agreement. Counsel for the petitioners volunteers that the petitioners would be given to understood the above action is at the instance of the Cuttack Municipal Corporation. It is even alleged that in the course of entering in to such agreement vide Annexure-1 series and even transaction of money, some Municipal Officials used to visit and have participation in such exercise. 2.

Keeping in view the nature of allegation, this Court finds it will not be appropriate to take up the issue by way of disposal of representation. The matter since involves a serious issue involving agreement for illegal sale of houses to the owners on false impersonation and under false impression, this Court finds series of F.I.R. already

// 2 // submitted and keeping in view the nature of transaction, the allegation involved herein and F.I.Rs already taken into action, for the opinion of this Court, law will take its own course. The matter is under investigation with even arrest of some culprits. So far the grievance at the instance of the petitioners since not available to be considered by way of representation, if so advised, petitioners may find appropriate remedy for the purpose. 2. With this observation, the entire writ petitions stand disposed of.

Copy of this order may be sent to the Commissioner, Municipal Corporation, Cuttack by Registry of this Court. 4.

A free copy of this order be given to Mr.Ghose, learned Additional Standing Counsel.
