This matter is taken up through virtual/physical mode. 1.

Petitioner is stated to have availed an Agriculture Loan for a sum of Rs.1,95,000/- on 25.02.2003 from Indian Overseas Bank, Mujagada Branch, DistrictGanjam. Due to financial indiscipline, the loan account was classified as NPA on 01.07.2010. The Bank to recover the outstanding liability of around Rs.7,16,081/- issued a notice dated 21.01.2021 (Annexure-3) directing the petitioner to pay the outstanding dues within fifteen days failing which they would proceed to sell by public auction the gold ornaments pledged with the Bank as a security for the aforesaid loan.

2. The petitioner apart from challenging the aforesaid notice dated 21.01.2021 (Annexure-3) has prayed for a mandamus to the Bank to settle the liability under a One Time Settlement Scheme.

Learned counsel for the Bank appearing upon notice submits that before the National Lok Adalat held on 22.04.2018 it was agreed that upon deposit of a sum of Rs.1,05,000/- by 22.05.2018 the outstanding loan account would stand closed (as the other loan account already stood closed). Learned counsel further submits that apart from deposit of Rs.1,000/- not a single penny was paid.

4. On the previous date of hearing none had appeared nor has anyone appeared today.

5. In view of the facts as narrated by the learned counsel for the Bank, we find no grounds to entertain the Writ Petition.

The Writ Petition is accordingly dismissed.
