Following the decision of the Hon'ble Apex Court in the case of N.P.Ponnuswami Vs. Returning Officer, Namakkal Constituency, Namakkal, Salem Dist. and four others, AIR 1952 SC 64, since petitioner has a statutory remedy to agitate such issue and adjudication, no writ petition in the circumstance is entertainable. Dismissal of the writ petition however shall not stand on the way of the petitioner in approaching under appropriate forum and getting the issues involved adjudicated.
