This matter is taken up through Hybrid mode.

This petition has been filed by the Petitioner to transfer MAT Case No.193 of 2021 instituted at the instance of the Opposite Party-wife from the court of learned Civil Judge (Senior Division), Nuapada to the court of learned Judge, Family Court, Rourkela.

Heard learned counsel for the parties.

It is stated by the learned counsel for the Petitioner that Civil Proceeding No.242 of 2021 filed by the present Petitioner for restitution of conjugal rights is pending before the learned Judge, Family Court, Rourkela and the other case i.e. MAT Case No.193 of 2021 for decree of divorce has been filed by the Opposite Party-wife before the learned Civil Judge (Senior Division), Nuapada. Therefore, the Petitioner seeks transfer of

// 2 // the aforesaid MAT Case No.193 of 2021 to the court of Judge, Family Court, Rourkela.

Considering the facts and the submissions made, this Court directs that MAT Case No.193 of 2021 pending on the file of learned Civil Judge (Senior Division), Nuapada be transferred to the court of Judge, Family Court, Rourkela. Both the courts shall do the needful on production of the certified copy of this order and intimate the same to the opposite party. Learned Judge, Family Court, Rourkela is directed to hear both the cases analogously and dispose of the same as expeditiously as possible, preferably within six months hence. 6.

With the aforesaid order, this TRP(C) stands disposed of.

Urgent certified copy of this order be granted on proper application.
