This matter is taken up through hybrid mode.

On oral prayer of learned counsel for the Petitioner he is permitted to implead State of Odisha represented through its Principal Secretary, Revenue and Disaster Management Department, Government of Odisha, Bhubaneswar as Opposite Party No.4 to the writ petition.

Necessary correction may be carried in the cause title of the writ petition in Court itself.

Petitioner in this writ petition seeks for a direction for early disposal of Revenue Misc. Case No.78 of 2010 pending before Officer on Special Duty (LR) Panposh, Rourkela. 5.
Mr. Jena, learned counsel for the Petitioner submits that after remand from the appellate authority, the OSD (LR)- Opposite Party No.1 has sought for report from the Block Development Officer, Lathikata as well as Tahasildar, Lathikata
// 2 // vide order dated 28th September, 2021. On the plea that the reports have not yet been received, the case is pending for which the Petitioner is seriously prejudiced. Hence, the Petitioner's request for early disposal of Revenue Misc. Case No. 78 of 2010 went in vain. Hence, this writ petition has been filed for the aforesaid relief.

Mr. Mishra, learned AGA submits that he has no instruction and prays for an adjournment of the case. 7.
Taking into consideration the fact that the matter is pending awaiting report from the BDO, Lathikata and Tahasildar, Lathikata, this Court without waiting for response from the Opposite Parties proceedes with the matter. 8.
Taking into consideration the nature of prayer made in this writ petition, this Court, without expressing any opinion on the merit of the case of the Petitioner, disposes of the writ petition with a direction that the OSD (LR)-Opposite Party No.1 shall consider and dispose of Revenue Misc. Case No. 78 of 2010, as expeditiously as possible, preferably within a period of four months from the date of production of certified copy of this order, if there is no legal impediment.
Issue urgent certified copy of the order on proper application.
