10.01.2022 06.
This matter is taken up through video conferencing mode.
Heard learned counsel for the petitioner and learned counsel for the State.
This is an application for bail under section 439 of Cr.P.C. in connection with Mathili P.S. Case No.0021 of 2020 corresponding to T.R. Case No. 29 of 2020 pending in the file of learned Addl. The prayer for bail of the petitioner was rejected by the learned Addl. Sessions Judge -cum-Special Judge, Malkangiri vide order dated 15.02.2021. Learned counsel for the petitioner submitted
// 2 // that one of the co-accused, namely, Prahallad Banjara had approached this Court in CRLMC No. 2226 of 2021 and he has been directed to be released on bail because of non-submission of charge sheet within the stipulated period as per order dated 17th November 2021 taking into account the provisions under section 36A(4) of the N.D.P.S. Act and since the petitioner is similarly situated, he wants to withdraw this bail application in order to move the learned trial Court for bail on that ground.
In view of such submission, the BLAPL stands disposed of as withdrawn.
