Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 23.10.2021 in connection with Dharamgarh P.S. Case No.158 of 2021 corresponding to C.T. Case No.92 of 2021 (POCSO) pending in the Court of learned Addl. Sessions Judge-cum-Special Court under POCSO Act, Bhawanipatna, Kalahandi for the alleged commission of offence under Sections 363/366A/370(4)/354-A/34 of IPC. 4.
It is alleged that the petitioner and the victim developed friendship by chatting on the social media and thereafter the petitioner is said to have lured the victim to accompany him. While the petitioner made certain physical overtures while they were going in a train he was apprehended by the railway police.

Considering the nature of accusations and the minor age of the victim, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is however open to the petitioner to renew his prayer after examination of the victim during trial in the case. 6.
BLAPL is accordingly rejected.
